Conditions of participation sweepstakes (Instagram)

Participants:
Only fans of our page, i.e. the Instagram page “DrainMaster” (@DrainMaster) can take part in the competition. Each natural person can only participate once in the competition. Participation only from 18 years, participant resident in Germany. Travel expenses are not covered. Company employees or other persons directly involved in the organization of the competition are excluded.
Profit:
The first place winner will receive a set of 3 DrainMaster Drip Stands. Second place wins a DrainMaster Drip Stand set with bowl. Third place will receive a 50% discount on a DrainMaster Drip Stand.
Period, possibility of participation and implementation of the contest:
The competition starts on 02.10.2023 at 10:00 am and ends on 09.10.2023 at 11:59 pm. The winner will be chosen at random on 10.10.2023. Please note, multiple comments do not increase your chances of winning. Only people over the age of 18 who are resident in Germany can take part.
The winners will be drawn at random from all participants who follow our Instagram page “DrainMasterDE” (@DrainMasterDE), click on “Like” during the participation period and also leave a comment under the competition post by 10.10.2023 at the latest.
The winners will be published on the organizer’s fan page with their Instagram username. The participant agrees to the publication of his username within the posting for the winner notification. Winners must contact us by personal message within seven days of notification of the winner, giving their address. If we do not receive a winner’s address within seven days of notification of the win, the winner’s prize will be forfeited. The addresses of the winners will be used exclusively for sending the prizes. More information on this follows below under “Data protection”. The shipment of the prizes is free of charge once and only possible to an address within Germany. Only one delivery attempt will be made by courier. If the recipient has not picked up the shipment at the DHL location in due time, the shipment will be returned to the customer by DHL. The recipient must bear the costs for a new delivery, if he/she wishes this.
Comments must not contain insults, false facts, competition, trademark or copyright infringements. The participant releases us from liability due to violations in this regard.
Dissociation from Instagram:
This sweepstakes is in no way affiliated with, sponsored, endorsed or organized by Facebook and Instagram. The sole person responsible and contact person for the competition is Roman Kobosil.
Instagram exemption:
By participating in the competition, the participant releases Instagram from any liability.
Privacy:
The personal data provided by the participant, in particular Instagram user name and, in the event of winning, first and last name, street, postal code and city will be stored, processed and used by the organizer in compliance with the regulations of data protection, in particular the Federal Data Protection Act and the General Data Protection Regulation (DS-GVO) for the purpose of carrying out and processing the competition. By participating in the competition, the participant agrees to the processing of data by the organizer. The participant also agrees that his/her personal data will be transmitted by the organizer to the company commissioned to carry out the competition exclusively for the purpose of carrying out and processing the competition. The data will not be passed on to other third parties. The participant has the right to receive, upon request and free of charge, information about the personal data stored about him. In addition, the participant has the right to correct incorrect data, blocking and deletion of his personal data, provided that this does not conflict with any legal obligations to retain data. In addition, the participant has the right to complain to the competent supervisory authority. In addition, the Participant has the right to receive the personal data concerning him or her that he or she has provided to the Organizer in a structured, commonly used and machine-readable format, and he or she has the right to transmit this data to another controller without hindrance from the controller to whom the personal data was provided. When exercising the aforementioned right to data portability, the participant has the right to obtain that the personal data be transferred directly from the organizer to another responsible party, insofar as this is technically feasible. The data will be deleted after the competition has been carried out and completed.
Right to object:
Each participant has the right to object at any time to the processing of personal data concerning him/her, to which he/she had previously consented, by sending a simple email to the organizer at the following email address: info@drain-master.de. The organizer shall no longer process the personal data unless it can demonstrate compelling legitimate grounds for the processing which override the interests, rights and freedoms of the participant concerned, or for the establishment, exercise or defense of legal claims.
Other:
If important reasons are presented which prevent the organizer from carrying out the competition through no fault of his own, the organizer can cancel the competition. In case of violation of the conditions of participation or attempt of manipulation or deception, the participants concerned can be excluded. Cash payment of the non-cash prizes is not possible. The winnings are not transferable to third parties. The sole person responsible and liable for the competition is Roman Kobosil. The entire legal relationship between the participant and the organizer shall be governed exclusively by the laws of the Federal Republic of Germany.
